• Tribal firms without competition may secure federal contracts. (OMB Circular A-76).
• Sole source / single source awards to Tribal firms have no limit on contract values (FAR 19.805- 1 and 13 CFR 124.506).
• Direct-awarded contracts to Tribal firms cannot be protested (13 CFR 124.517).
• A 5% bonus (based on the subcontract value) can be awarded to prime contractors for using Tribal firms
(DFARs 226.1 or FAR 26.102).
• The size of an Indian-owned enterprise, for small business eligibility purposes, is determined without consideration of the economic size of its parent (13 CFR 124.109).
